OVERVIEW
Welcome to Mikas Aromas. These Terms of Service (“Terms”) govern your use of the Mikas Aromas website, online store, products and related services (collectively, the “Services”).
Mikas Aromas is owned and operated by Mikas Aromas LLC, an Ohio limited liability company. Throughout these Terms, “Mikas Aromas,” “we,” “us” and “our” refer to Mikas Aromas LLC.
Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to offer our products and Services to you.
By visiting our website, purchasing from us or otherwise using our Services, you agree to these Terms and our applicable policies. If you do not agree with these Terms, please do not use the Services.
1. ELIGIBILITY AND ACCOUNTS
By using our Services, you represent that you are at least the age of majority in your state or jurisdiction of residence or that you have permission from a parent or legal guardian where required.
You agree to provide accurate, current and complete information when placing an order or creating an account.
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account.
2. PRODUCTS
Mikas Aromas offers fragrance, body care and related products, including handcrafted products made in small batches.
We make reasonable efforts to accurately display and describe our products. However, product appearance, packaging, color and other visual characteristics may vary slightly from photographs or from what is displayed on your device.
Because many products are handcrafted or produced in small batches, minor variations between batches may occur and do not necessarily indicate a product defect.
Fragrance perception is subjective. Individual experiences with scent, strength, projection, longevity and fragrance notes may vary based on skin chemistry, application method, environment and personal perception.
We reserve the right to modify or discontinue products without notice.
3. FRAGRANCE DISCLAIMER
Certain Mikas Aromas products may be described as being inspired by, reminiscent of or comparable in scent profile to designer, niche or other commercially available fragrances.
Unless expressly stated otherwise, Mikas Aromas LLC is not affiliated with, endorsed by, sponsored by or associated with the original fragrance houses, designers or trademark owners referenced for comparison purposes.
Any third-party trademarks or brand names are used solely for identification and fragrance-comparison purposes. All trademarks remain the property of their respective owners.
4. PRODUCT USE AND SAFETY
Customers are responsible for reviewing product descriptions and ingredient information before use, particularly if they have known allergies, sensitivities or medical concerns.
Discontinue use if irritation or an adverse reaction occurs.
Unless specifically stated otherwise, Mikas Aromas products are intended for external cosmetic or fragrance use only.
Our products and information are not intended to diagnose, treat, cure or prevent any disease or medical condition, and information provided through our Services should not be considered medical advice.
5. ORDERS
Submitting an order constitutes an offer to purchase the selected products.
We reserve the right to accept, decline, limit or cancel an order when reasonably necessary, including in cases involving suspected fraud, pricing or inventory errors, payment issues or suspected unauthorized resale.
An order is not considered accepted until payment has been successfully processed and the order has been accepted for fulfillment.

6. PRICING AND PAYMENT
Prices, promotions, discounts and product availability may change without notice.
The price charged will be the price displayed at the time your order is submitted, subject to correction of obvious pricing or technical errors.
Applicable taxes and shipping charges will be calculated or displayed during checkout when required.
You agree to provide accurate billing and payment information and represent that you are authorized to use the payment method submitted with your order.
7. ORDER CANCELLATIONS
Cancellation requests must be submitted within 12 hours of purchase or before the order ships, whichever occurs first.
Once an order has been processed and shipped, it cannot be cancelled.
Submitting a cancellation request does not guarantee that an order can be cancelled if processing or fulfillment has already begun.
8. RETURNS, REFUNDS AND EXCHANGES
Due to the personal nature of fragrance and body care products and because many products are handcrafted or made to order, all sales are final once an item has shipped.
We do not accept returns or exchanges for reasons including personal fragrance preference, change of mind or ordering the incorrect product.
If your order arrives damaged or you receive an incorrect item, contact us within 48 hours of delivery with your order number and photographs of the product and packaging so we can review the issue.

9. SHIPPING AND DELIVERY
Orders are generally processed within 1–7 business days, excluding weekends and holidays. Large, custom or high-volume orders may require additional processing time.
Shipping and delivery estimates are not guarantees.
Once an order has been transferred to the shipping carrier, delivery timing may be affected by circumstances outside our control.
Customers are responsible for providing a complete and accurate shipping address at checkout.
Tracking information will be provided when available. Please allow time for carrier tracking systems to update after shipment.

10. INTELLECTUAL PROPERTY
Unless otherwise stated, content appearing through the Mikas Aromas Services—including our original text, graphics, logos, branding, photographs, product names, original fragrance names, formulations, designs and other original materials—is owned by or licensed to Mikas Aromas LLC and is protected by applicable intellectual property laws.
You may use the Services for personal, non-commercial purposes.
You may not reproduce, distribute, republish, commercially exploit, scrape or otherwise use our proprietary content, formulations, photography or brand assets without prior written authorization.
Nothing in these Terms transfers ownership of Mikas Aromas intellectual property to you.
Third-party names and trademarks remain the property of their respective owners.
11. REVIEWS, FEEDBACK AND USER CONTENT
If you voluntarily submit reviews, photographs, comments, suggestions or other content to Mikas Aromas, you represent that you have the right to provide that content and that it does not violate another person’s rights.
You grant Mikas Aromas a non-exclusive, worldwide, royalty-free license to use, reproduce, display and share content you voluntarily submit in connection with operating, marketing and promoting our business and products, subject to applicable law.
We reserve the right to remove content that is fraudulent, unlawful, abusive, misleading or otherwise inappropriate.
12. THIRD-PARTY SERVICES AND LINKS
Our Services may use or link to third-party platforms and service providers, including Shopify, payment processors, shipping carriers and social media platforms.
We are not responsible for the content, availability, privacy practices or policies of independent third-party websites or services.
Your use of third-party services may be governed by their own terms and privacy policies.
13. RELATIONSHIP WITH SHOPIFY
Our online store is powered by Shopify, which provides the ecommerce technology used to operate portions of the Services.
Purchases made through our store are transactions between you and Mikas Aromas LLC, not Shopify.
Shopify is not the seller of Mikas Aromas products and is not responsible for the manufacture, fulfillment, quality or use of products purchased from Mikas Aromas.
14. PRIVACY
Our collection, use and disclosure of personal information is governed by our Privacy Policy.
Shopify and other service providers may also process information as necessary to provide ecommerce, payment, analytics, security and related services.

15. PROHIBITED USES
You may not use our Services:
- For unlawful, fraudulent or malicious purposes;
- To violate applicable laws or regulations;
- To infringe upon intellectual property or other legal rights;
- To transmit malware, viruses or harmful code;
- To interfere with the security or operation of the Services;
- To scrape, copy or commercially exploit proprietary website content without authorization;
- To impersonate another person or provide intentionally false information;
- To collect personal information about others unlawfully; or
- To engage in conduct that could damage Mikas Aromas, our customers or our service providers.
We reserve the right to restrict or terminate access to the Services for violations of these Terms.
16. ERRORS AND INACCURACIES
Occasionally, information on our website may contain typographical errors, inaccuracies or omissions involving product descriptions, pricing, promotions, shipping charges, availability or other information.
We reserve the right to correct errors, update information or cancel affected orders when reasonably necessary.
17. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by applicable law, the Services and products are provided on an “as is” and “as available” basis except where an express warranty is specifically provided.
We do not guarantee that access to the website will always be uninterrupted, secure or error-free.
Individual fragrance experiences and product results vary, and we do not guarantee a particular subjective fragrance experience, longevity, projection or personal preference.
Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
18. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Mikas Aromas LLC and its owners, employees, contractors and service providers will not be liable for indirect, incidental, special, punitive or consequential damages arising from use of the Services or products.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
19. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless Mikas Aromas LLC and its owners, employees, contractors and service providers from third-party claims, damages or reasonable expenses arising from your unlawful use of the Services, your violation of these Terms or your infringement of another person’s rights.
20. SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as necessary.
The remaining provisions will continue in effect.
21. WAIVER AND ENTIRE AGREEMENT
Failure by Mikas Aromas to enforce a provision of these Terms does not constitute a waiver of that provision.
These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy and other policies displayed through the Services, constitute the agreement governing your use of the Services.
22. GOVERNING LAW
These Terms and your use of the Services are governed by applicable federal law and the laws of the State of Ohio, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
23. CHANGES TO THESE TERMS
We may update these Terms periodically to reflect changes to our Services, business practices or legal requirements.
The current version will be posted on our website with an updated effective date. Continued use of the Services after an updated version becomes effective constitutes acceptance of the revised Terms to the extent permitted by law.
